El objetivo principal fue identificar las deficiencias normativas que permiten omisiones en la inclusión de herederos legítimos. Se desarrolló un estudio de tipo básico, con enfoque cualitativo, nivel descriptivo y diseño basado en teoría fundamentada. La muestra estuvo conformada por 10 expertos en derecho sucesorio, a quienes se aplicó una guía de entrevista semiestructurada. Además, se consultaron fuentes doctrinarias, jurisprudencia, y normativas nacionales e internacionales. Los resultados evidencian que la falta de verificación de vínculos familiares por parte de los notarios, sumada a la limitada interoperabilidad entre entidades como RENIEC y SUNARP, facilita omisiones intencionadas. Se propone incorporar el artículo 29-A a la Ley N.o 1049, estableciendo la obligación del notario de verificar, bajo responsabilidad, la información hereditaria. Se concluye que es urgente reformar la normativa vigente para garantizar procesos sucesorios más transparentes, justos y equitativos, asegurando la inclusión de todos los herederos legítimos.
