description El trabajo de investigación se realizó con el objetivo de explicar como se configura la responsabilidad penal del notario en la comprobación del testamento, Ayacucho, 2021, siguiendo el enfoque cualitativo, diseño de teoría fundamentada y de tipo básico de investigación, se utilizó como técnica de recolección de datos la entrevista y la técnica de análisis documental, doctrinario y normativo; aplicando sus respectivos instrumentos como la guía de preguntas de entrevista, guía de análisis documental, doctrinaria y normativa. Las entrevistas se aplicaron a los participantes conformados por abogados especialistas en derecho notarial, registral, civil y notarios. Se procedió a procesar los datos con la técnica de análisis de datos de la interpretación jurídica, alcanzando los resultados, la discusión y concluyendo que en relación al objetivo general, que la responsabilidad penal del Notario en la comprobación del testamento, se configura a través de una mala praxis y el abuso de autoridad, para alcanzar un beneficio personal y ocasiona daños y perjuicios a terceras personas.
