En cuanto a la metodología, se ha desarrollado una investigación de tipo básica no experimental de enfoque cualitativo, con un diseño de investigación, diseño general: explorativa y diseño específico: teoría fundamentada. Para los instrumentos de recolección de datos se emplearon: entrevistas y análisis de la norma competente de la conciliación. Como resultado de este estudio se pudo ver que la conciliación extrajudicial es un mecanismo efectivo para reducir la carga procesal. Como conclusión se pudo ver que el Estado no asigna el presupuesto pertinente para difundir a la conciliación extrajudicial a modo de masificarla a todos los sectores del país
