description En esta investigación se analizó la regulación normativa electoral a través de la cual se pudo identificar la necesidad de garantizar la efectiva representación indígena congresal de regiones con poblaciones indígenas, por lo cual se planteó como problema general: ¿Cómo garantizar la efectiva representación política congresal en regiones con población indígena, 2022? El tipo de investigación fue básica, se siguió el diseño cualitativo y como tipología a la investigación fenomenológica. Asimismo, se empleó como categorías a la representación política y a la población indígena y como subcategorías: la toma de decisiones, iniciativas legislativas, proyectos en interés de la región, nivel de injerencia en la población indígena, principio de interculturalidad y enfoque de derechos humanos. Se arribó a la conclusión que las regiones con poblaciones indígenas no se encuentran efectivamente representadas en el Congreso porque los congresistas no conocen la realidad de estos pueblos y las propuestas que llevan a debate en el Congreso no se acerca siquiera a las preocupaciones de las comunidades indígenas; razón por lo que se torna indispensable un cambio legislativo en el artículo 116 de la Ley Orgánica de Elecciones – Ley N°26859 que a través de la obligatoriedad los incluyan.
