Del cual se descubrió que la responsabilidad médica se origina del error médico debido a la infracción de los parámetros establecidos por Lex Artis para el personal médico y establecimiento de salud conforme al método hermenéutico. Del cual el resultado se subsume a consecuencias jurídicas por responsabilidad médica, contractual, extracontractual y falla en diagnóstico. Se concluye, que la responsabilidad del médico y del establecimiento de salud, frente al paciente víctima de error medico, está cohesionada con la responsabilidad penal y administrativa; cohesionado con lo regulado en los artículos 36 y 111 el Código Penal; artículos 36 y 48 la Ley General de Salud 26842; en concordancia con el artículo 1969 y 1981 del Código Civil.
