description El actual trabajo de investigación, tuvo como objetivo general Demostrar que el consentimiento de siniestro en nuestra legislación no está adecuado a la realidad con los plazos otorgados, beneficiando así muchas veces erróneamente a los asegurados por un siniestro que no tiene cobertura, desvirtuando así la finalidad del seguro, así mismo a través del análisis del registro documental y de entrevistas a expertos en la materia, se obtendrán datos y resultados que luego serán procesados a través del análisis doctrinario y teórico así como la posición de expertos, para la realización de la investigación se empleará el enfoque cualitativo, así mismo, el tipo de estudio es básico y orientado a la comprensión conteniendo un diseño de teorías fundamentadas.
