La metodología utilizada es de tipo aplicada, experimental. La población estuvo compuesta por 12 notarios de la provincia de Chiclayo y 8694 abogados del Colegio de Abogados en Lambayeque; la muestra se conformó por 06 notarios con competencia en la provincia de Chiclayo y 30 abogados especialistas en Derecho de Sucesiones y Derecho Notarial; se usó como técnica la encuesta e instrumento el cuestionario. Se obtuvo que el 77.80% de los encuestados cree que es necesario proponer una ley que regule la implementación de un trámite notarial complementario a la sucesión intestada para la inclusión de herederos preteridos, y el 22.20% manifestó su desacuerdo. Esta tesis concluyó que se debe proponer una ley que regule la implementación de un trámite notarial complementario a la sucesión intestada para la inclusión de herederos preteridos a fin de que aquellos que han sido afectados puedan accionar.
