description La presente investigación titulada: Interés superior del niño y libre orden de apellidos: Reflexiones jurídicas sobre la modificación del artículo 20 del Código Civil, tuvo como objetivo general: Analizar en qué medida la libre elección del orden de los apellidos garantiza el interés superior del niño y es compatible con la Convención sobre los Derechos del Niño de 1989. En cuanto al aspecto metodológico empleado fue de enfoque cualitativo, con diseño de teoría fundamentada, se realizó entrevistas como parte de los instrumentos para la recolección de datos. Se pudo conocer en mérito de los resultados que tuvo un efecto positivo, en cuanto a la libre elección de orden de apellidos. Se concluyó que es importante una modificatoria idónea del mencionado artículo para que se hagan efectivos los derechos del menor y progenitores, impidiendo la vulneración del derecho a la identidad, igualdad y no discriminación, precisando una regulación idónea que conlleve al bienestar integral.
