description El presente trabajo pretende estudiar los aspectos legales del financiamiento participativo financiero o ‘‘crowdfunding’’ que fue regulado en Perú mediante el Decreto de Urgencia Nº13-2020 y su recientemente publicado Reglamento mediante la Resolución de Superintendente N°045-2021-SMV/02. En particular, esta nueva e innovadora forma de obtener financiamiento se encuentra en proceso de crecimiento en país, motivo por el cual, en el presente trabajo de investigación se analizan algunas reflexiones respecto a aspectos legales que deberían tomarse en cuenta tanto para regular esta materia, así como para determinar cómo hacerla viable a la luz de la prohibición de captación de recursos del público como actividad reservada para las instituciones financieras y el pleno respeto a los principios de transparencia y protección al inversionista que rigen en el ordenamiento jurídico peruano.
