description El objetivo del estudio fue analizar de qué manera se debería regular normativamente la investigación suplementaria de oficio en marco del debido proceso dentro del Código Procesal Penal peruano. Para ello, se empleó una metodología con enfoque cualitativo, de tipología básica, método inductivo y diseño fenomenológico, con un alcance explicativo. Asimismo, la muestra fue determinada por muestreo no probabilístico por conveniencia, incluyendo a ocho fiscales del Ministerio Público especializados en derecho penal, a quienes se les hizo guía de entrevista semiestructurada. Los resultados indicaron que la investigación suplementaria de oficio, con ausencia de una adecuada regulación, vulnera fundamentos como imparcialidad judicial y búsqueda de la verdad, y se crea así incertidumbre jurídica y riesgo de arbitrariedad. Por ello, en contraposición, se identificó que una regulación normativa precisa podría evitar estos conflictos, estableciendo límites claros, supuestos excepcionales y mecanismos de control, fortaleciendo así la coherencia de la forma acusatoria y excelencias del adecuado paso. En conclusión, la regulación normativa expresa y restrictiva de la investigación suplementaria de oficio resulta necesaria y esencial para salvaguardar los derechos fundamentales y asegurar el adecuado paso y equilibrio en el paso penal.

Para ello, se empleó una metodología con enfoque cualitativo, de tipología básica, método inductivo y diseño fenomenológico, con un alcance explicativo. Asimismo, la muestra fue determinada por muestreo no probabilístico por conveniencia, incluyendo a ocho fiscales del Ministerio Público especializados en derecho penal, a quienes se les hizo guía de entrevista semiestructurada. Los resultados indicaron que la investigación suplementaria de oficio, con ausencia de una adecuada regulación, vulnera fundamentos como imparcialidad judicial y búsqueda de la verdad, y se crea así incertidumbre jurídica y riesgo de arbitrariedad. Por ello, en contraposición, se identificó que una regulación normativa precisa podría evitar estos conflictos, estableciendo límites claros, supuestos excepcionales y mecanismos de control, fortaleciendo así la coherencia de la forma acusatoria y excelencias del adecuado paso.
