description En la presente tesis se aborda la necesaria modificación del artículo 313 del Código Penal referente al delito contra el medio ambiente, en su modalidad de Alteración del Ambiente, ya que en la actualidad existen supuestos que no fueron previsto por el legislador en código penal de 1991 como son la remoción de tierras, corte de talud, quema de pastizales, desviación de cauce de rio e inserción de especies; hechos que alteran el ambiente o paisaje y modifican la flora y fauna, los mismos que afectan el derecho constitucional de gozar un ambiente equilibrado y adecuado al desarrollo de su vida. Bajo este contexto la modificación permitirá una mejor protección del ambiente ya que las instituciones encargadas de velar por la protección no lo vienen realizando de forma eficiente es así que se puede determinar la existencia limitativa de la norma frente a las circunstancias de la actividad humana, es necesario crear conciencia sobre el espacio y territorio, así mismo sobre el uso sostenible de los recursos naturales para el aprovechamiento de futuras generaciones.

Under this context, the modification will allow a better protection of the environment since the institutions responsible for ensuring protection are not doing so efficiently, so that the limitative existence of the norm can be determined in the face of the circumstances of human activity.
