description La presente tesis busca estudiar los principales alcances del financiamiento por terceros en el arbitraje (específicamente, el arbitraje comercial) como alternativa para llevar adelante un caso, ello en orden de analizar las principales contingencias para los intervinientes de la operación de financiamiento (financista y parte financiada) y los actores propios del arbitraje financiado (abogados patrocinantes, árbitros, etc). En consecuencia, la presente investigación estima que incidir en un mercado donde existe un sector de empresarios dispuestos a invertir sobre las posibilidades de éxito de cierta causa litigiosa en el sector corporativo, podría generar problemas que pudiesen tener algún grado de importancia en el curso del arbitraje per se, situación que conllevaría al análisis de (i) determinada problemática, (ii) la revisión de la práctica internacional al respecto y (iii) la propuesta de ciertos alcances vinculados a sentar un buen panorama de anticipo de dichas consecuencias.
