El presente artículo aborda el debate en la doctrina italiana sobre la pertinencia del concepto del Negocio Jurídico dentro de dicho ordenamiento jurídico. el autor aborda de manera crítica las distintas posturas sobre el tipo de categoría jurídica que sería el negocio jurídico. Concluye señalando que el negocio jurídico no es sino una categoría analógica en el ordenamiento jurídico italiano, negando además su carácter ahistórico. Por tanto, se cuestiona la utilidad y pertinencia de la categoría jurídica del Negocio Jurídico en la actualidad.  This article discusses the debate in the italian doctrine about the relevance of the concept of the “negozio giuridico” within that legal system. He discusses critically the different positions on the type of legal category that would be the “negozio giuridico”. He concludes pointing out that the “negozio giuridico” is not but an analog category in the italian legal system, denying furthermore its ahistorical character. therefore, he questions the usefulness and relevance of the mentioned legal category at present.
