Likewise, this work highlights the legal remedies applicable in case the ordinary risk of non-performance arises, due to unjustified refusal for the timely execution of the final contract.En el presente artículo se comentan críticamente los alcances de la regulación legislativa sobre el compromiso de contratar, poniendo de relieve que, por su naturaleza contractual en razón de su objeto obligacional, resultan aplicables las reglas formativas de los contratos, destacándose que, en razón del contenido del acuerdo preliminar y durante su vigencia temporal que debe ser necesariamente predeterminada, se formula una oferta de vinculación definitiva de lo ya acordado íntegra y preliminarmente, la misma que debe ser aceptada bajo responsabilidad, salvo causa justificante.
