Sumario:This paper analyzes copyright versus Appropriation art, which is widespread in the art world, as well as to determine a proper regulation of artistic appropriation as an exception to copyright in the closed system of exceptions and limits. For this purpose, the requirement of originality in artworks is analyzed, as well as the philosophy and intention of the appropriationist authors. Then, an analysis of moral and economic rights is made in convergence with different cases of artistic appropriation at national and international level. Finally, this paper establishes that appropriation art, frequent in Peru, causes the inevitable violation of the right of transformation if it is done without authorization, which is why it should be regulated as an exception to protect the artist’s freedom of expression under the same parameters as parody. Thus, artistic appropriation can be regulated only when it constitutes an unauthorized transformation and in the creation of visual arts work, which does not violate the Three-Step Rule or generate an excessive prejudice to the copyrights of third parties.
