It is emphasized that a modernization of family law does not involve the renunciation of the family law principles.En el Perú, persisten temores en torno a la reforma del libro de derecho de familia; luego de 40 años de vigencia del Código Civil de 1984, el autor persiste e incorpora nuevas razones para acceder a su ‘contractualización’ como reflejo de una sociedad que cada vez está menos dispuesta a contraer matrimonio. Estamos frente a una regulación que prolonga la crisis matrimonial y es contraproducente para el propio ordenamiento. El artículo se sirve de la experiencia norteamericana y de las iniciativas de la Uniform Law Commission o el American Law Institute para demostrarla complementariedad que puede existir entre la libertad de las partes al momento de celebrar acuerdos maritales o premaritales y el posterior escrutinio judicial.
