In that sense, this research analyzed from all fonts the real situation of individuals in the process of formalizing compared with current regulations, to review the issues related to authorization certificates or permits, and other newly regulated requirements, which will have attributed the name “Inexorable Components” under the formalization process regulated by Legislative Decree N.o 1105, being of compliance required to obtain the Authorization of Start or Re-start Operations that allows the change of status of the mining rights holder from “Formalizing Process” to “Formalized Subject”. Finally, the article will reveal the implications and problems that have been noticed in the course of the execution of the process, highlighting their strengths and weaknesses; withEl presente artículo describe y analiza el desarrollo legislativo del proceso de formalización de la pequeña minería y de la minería artesanal, que ha sido instituido con el objetivo de combatir la minería ilegal. En ese sentido, esta investigación analiza desde todos sus frentes la situación real de los sujetos en proceso de formalización, comparándola con la normativa vigente, hasta revisar los aspectos relacionados a títulos habilitantes o permisología, y otras exigencias recientemente reguladas, a las que se les ha atribuido la denominación de «componentes inexorables» en el marco del proceso de formalización regulado por el Decreto Legislativo N.o 1105, por ser de necesario cumplimiento para la obtención de la autorización de inicio o reinicio de operaciones que genera el cambio de situación del titular minero en vía de formalización, de sujeto en proceso de formalización a sujeto formalizado.
