It argues that, in certain cases, the Court's exercise of this power has exceeded the role of a negative legislator, assuming the powers of the Legislative Branch by creating procedural institutions not provided for by law. This constitutes judicial activism and undermines legal certainty and the separation of powers. Based on a doctrinal, jurisprudential, and comparative analysis, the article proposes establishing formal and substantive limits to preserve constitutional supremacy and institutional balance.  El artículo analiza críticamente la autonomía procesal del Tribunal Constitucional peruano como facultad para crear reglas procesales mediante jurisprudencia y precedentes vinculantes, destinada a suplir vacíos normativos y garantizar la tutela de derechos fundamentales. Sostiene que, en ciertos casos, su ejercicio ha excedido el rol de legislador negativo, asumiendo competencias del Poder Legislativo mediante la creación de instituciones procesales no previstas en la ley, lo que configura activismo judicial y afecta la seguridad jurídica y la separación de poderes.
