Being exact, we refer to a concept that involves subjective aspects, since human beings, through free will and decision-making, decide at what point and aspects they can be sure that their counterpart with their role, promise, work or responsibility in society, this means that in principle it is up to sociology to determine the nature and characteristics of trust. Without prejudice to recognizing trust as a starting point from its natural meaning, it is important for this research work to address the issue by influencing the historical - dogmatic content that is attributed to the so-called legitimate trust as a social expectation deposited in the State. , through the public administration, being a kind of guarantee against any action and inclusion of omission that occurs in the interactions that exist between the companies and the public administration; However, the same is expected in the internal organizational treatment of the state, not being exclusive only to private - public action but even public - public, that means that not only individuals outside the administrative function are expecting the correct performance of what is known as legitimate trust, but also the various public entities generate expectations in favor of this institution. It is because of the aforementioned that although its framing is currently established as a procedural principle recognized in the General Administrative Procedure Law - Law No. 27444, its scope has not been immune to controversies and even contradictions, so much so that it is generally It is linked to the resolution production in an administrative procedure through the line of interpretation assumed by a public entity and in some more extreme cases to the resolution production as precedents of obligatory observance, which as we will see is not the most appropriate. . In this sense, starting from the justification of the existence of the institution studied in the Peruvian legal system, we warn that it is necessary to consider that this treatment goes beyond the request made in an administrative procedure; If indeed there is disagreement in the use of this institution when it refers to the discretionary space proper to some administrative actions or even the contravention of the principle of legality, when faced with a guarantee principle, it is worth remembering that like any aspect related to the interest In general, there must be parameters or limits in terms of its application, which is why this does not prevent the promotion of a broad public law construction of the principle in terms of its application in administrative law, in order to achieve the public purposes of its application. object and purpose.

En ese escenario, es preciso el abordaje de la temática no desde su análisis positivo tal cual se encuentra previsto en la legislación administrativa peruana actualmente, sino desde su análisis histórico para identificar el por qué se le asocia especialmente al ámbito del derecho público y de esa forma comprender el dogma que trae consigo su incorporación al derecho como ciencia social que busca encuadrar la realidad social a través del establecimiento de normas jurídicas, que lo que buscan es generar escenarios de armonía en la convivencia social; no obstante, es propicio reconocer que la confianza, en cuanto a su significado, no es exclusivo del campo del derecho. Por tanto, el precitado concepto involucra aspectos subjetivos, ya que los seres humanos, mediante el libre albedrio y la toma de decisiones, deciden en que aspectos pueden estar seguros de que su contraparte cumplirá con su rol, promesa, trabajo o responsabilidad en la sociedad. , ello quiere decir que en principio corresponde a las diversas ciencias sociales determinar la naturaleza y característica de la confianza. Sin perjuicio de que se reconozca como punto de partida a la confianza desde su acepción natural, importa a este trabajo de investigación abordar la temática que incida en el contenido histórico – dogmático que le se le atribuye a la llamada confianza legítima como una expectativa social depositada en el Estado, a través de la administración pública, siendo una suerte de garantía frente a toda acción e incluso omisión que se presente en las interacciones que existen entre administrados y administración pública; no obstante, se espera lo mismo en el tratamiento interno organizativo del estado, no siendo privativa únicamente de la actuación privada – pública sino siendo extensiva a la actuación entre entes públicos, eso quiere decir que no solo los individuos ajenos a la función administrativa se encuentran expectantes del correcto desempeño de lo que se conoce como confianza legítima, sino que también las diversas entidades públicas generan expectativas en favor de esta institución que también corresponde al campo del derecho. Es por lo anteriormente señalado que si bien su cuadro se encuentra prefijado en la actualidad como un principio procesal reconocido en la Ley del Procedimiento Administrativo General – Ley Nº 27444, dicho alcance no ha sido ajeno a controversias e incluso contradicciones, tanto así que se comparan le vincula con la producción resolutiva en un procedimiento administrativo a través de la línea de interpretación asumida por parte de alguna entidad pública y en algunos casos más rigurosos a la producción resolutiva a modo de precedentes de observancia obligatoria, lo cual como veremos no es lo más adecuado.
