The document examines the aspects and principles that must be considered when the regulator defines or structures conducts that constitute infractions in any matter. The objective of the article is to explore and highlight the delimitation of the sanctioning authority of public entities, with a special focus on the Office of the Comptroller General of the Republic (CGR). In addition, the regulatory framework for the creation of infringing conducts is evaluated.Este artículo presenta un análisis detallado de la sentencia emitida el 24 de julio de 2024, correspondiente al Expediente N° 0026-2021-PI/TC, que establece los límites de la autoridad sancionadora de la Contraloría General de la República. En el presente documento se examinan los aspectos y principios que deben ser considerados cuando el regulador define o estructura conductas que constituyen infracciones en cualquier materia. El objetivo del artículo es explorar y resaltar la delimitación de la autoridad sancionadora que poseen las entidades públicas, con un enfoque especial en la Contraloría General de la República (CGR).
