Through the study of the presence of social, economic and cultural rights intransitional processes, shows there levance of the use of one or another legal epistemology on the causes of the suffering of the people.En este texto se estudian las razones que justifican la introducción de los derechos sociales, económicos y culturales (DESC) en los procesos de justicia transicional. Este estudio, que se centrará especialmente en el derecho a la propiedad y a la tierra, se enmarca en un ámbito de reexión más amplio: la relación entre la epistemología jurídica y el padecimiento de las personas derivado, por lo menos en parte, de estructuras político-jurídicas, militares, económicas o administrativas.
