Currently, only 21.8% of family units in Peru correspond to the traditional family, while 61.4% adopt other forms, such as single-parent, same-sex, and blended families, and the current legislation remains focused onprotecting only traditional family units,excluding those who do not fit this model.The analysis of the Registry Court’s resolutions shows that Peruvian legislation maintains a strict interpretation, excluding those without a spouse or dependent children from patrimonial protection. Although there has been some flexibility since 2013, these decisions have not effectively addressed the lack of protection for single-person households, leading to legal uncertainty.The article compares Peruvian legislation with that of Mexico, Colombia, Argentina, and Brazil, where more inclusive approaches have been adopted to protect individuals withouttraditional family ties. These legislationsreflect better adaptation to contemporary social realities.The conclusion highlights the urgent need to reform the Peruvian Civil Code to include and adequately protect all family configurations, ensuring equitable access to patrimonialprotection and aligning with the principles of equality and non-discrimination enshrined in human rights.El artículo analiza cómo las estructuras familiares en Perú han evolucionado y cómo el artículo 495 del Código Civil no refleja adecuadamente esta diversidad. Actualmente, solo el 21.8% de las unidades familiares en Perú corresponde a la familia tradicional, amientras que el 61.4% adopta otras formas, como monoparentales, homoparentales y reconstituidas, y el 16.8% son hogares unipersonales. Sin embargo, la legislación vigente sigue enfocada en proteger únicamente a las unidades familiares tradicionales, excluyendo a quienes no encajan en este modelo. El análisis de las resoluciones del Tribunal Registral muestra que la legislación peruana mantiene una interpretación estricta, excluyendo a los constituyentes sin cónyuge o hijos dependientes de la protección patrimonial. Aunque ha habido cierta flexibilización desde 2013, estas decisiones no han resuelto de manera efectiva la falta de protección para los hogares unipersonales, lo que genera inseguridad jurídica.El artículo compara la legislación peruana con la de México, Colombia, Argentina y Brasil, donde se han adoptado enfoques más inclusivos para proteger a individuos sin lazos familiares tradicionales.
