Meanwhile rule limiting fundamental rights, its analysis requires a successfully passed constitutional control that, in the particular case, is carried through the test of proportionality. Analyzed the steps that make up its structure, we see that the restrictions on specific rules that limit their exercise invade the substance of this right. Given this scenario, the author proposes an intermediate formula in two specific cases to balance and optimize the relative exercise of this right in relation to the legal bases that are opposable.El reconocimiento del derecho a las libertades comunicativas en los policías y militares encuentra en sus bienes jurídicos un firme obstáculo a su ejercicio, y en sus regímenes disciplinarios un mecanismo de censura capaz de limitar y controlar perversamente cualquier ámbito de actuación contrario a ello, aun cuando el acto comunicativo que se pretenda expresar sea de especial relevancia pública y tenga por propósito fomentar la transparencia en la actividad castrense. En tanto norma que limita derechos fundamentales, su análisis requiere superar un control de constitucionalidad que, en el caso particular, se realiza a través del test de proporcionalidad. Analizados los pasos que componen su estructura, veremos que las restricciones a las normas concretas que limitan su ejercicio invaden al contenido esencial de este derecho.
