It has been verified that, at the national level, Law 30846 has been in place since 2018:"Lawthat creates the National Palliative Care Plan for Oncological and Non- Oncological Diseases"; and with the Technical Document "National Plan of Palliative Care for Oncological and Non-Oncological Diseases in Peru 2021-2023”, however, there is no specific law on palliative care in Peru. Therefore, the present investigation; provide a bio-legal approach to the dignified treatment of the chronically ill in Peru. In this sense, it is proposed as a general objective: to establish guidelines based on a classic iusnaturalist position for the regulation of palliative care, with a biolegal approach, in favor of a dignified treatment of the patient in Peru. To achieve this objective, qualitative, descriptive and interpretative research was pursued.A continuación, se brinda una breve reflexión desde el enfoque del iusnaturalismo clásico al problema de la atención del enfermo incurable y/o terminal, rescatando el valor de la dignidad humana en la última etapa de la vida. A fin de lograr lo propuesto, se analiza la institución de los cuidados paliativos, verificado que, a nivel de Perú , se cuenta desde el año 2018 con la Ley 30846: “Ley que crea el Plan Nacional de Cuidados Paliativos para Enfermedades Oncológicas y no Oncológicas”, y con el Documento Técnico “Plan Nacional de Cuidados Paliativos para Enfermedades Oncológicas y No Oncológicas en el Perú 2021- 2023”; no obstante, se carece de una ley específica de cuidados paliativos, norma necesaria para efectivizar la atención integral del enfermo. Ante ello, se pretende establecer unas directrices biojurídicas basadas en el iusnaturalismo clásico, las que servirán de base para la posible elaboración de una Ley de cuidados Paliativos en Perú, logrando así un tratamiento digno del enfermo.
