Data were analyzed using SPSS v25, employing frequency analysis to determine percentages. 58.33% of respondents consider parental consent essential for minor marriage, while 33.3% do not. Judges have key roles: safeguarding the child's best interest (41.667%), assessing their psychological and physical state (33.33%), and preventing forced marriage (25%). The incapacity of parents or grandparents is relevant in 58.33% of decisions. Moreover, 41.60% consider a minor's pregnancy when deciding on a judicial dispensation. 50% are unaware of the legal meaning of emancipation, and 83.30% believe society is not prepared for adolescents to assume adult roles. The benefits of family emancipation are evenly divided between "Not important" and "Important" (50% each). It is concluded that there is a division of opinions on parental consent and discrepancies between legal capacity and adolescent maturity. The prohibition of marriage in minors poses challenges in parental responsibility and protection of adolescents' rights.El estudio, realizado entre enero y marzo de 2024 en Lima, buscó describir las implicaciones de la prohibición del matrimonio en menores en Perú respecto a la responsabilidad parental. Se encuestó a 12 magistrados mediante Google Forms para explorar sus opiniones. Los datos se analizaron con SPSS v25, utilizando análisis de frecuencias para determinar porcentajes. El 58,30% de los encuestados considera esencial el consentimiento parental para el matrimonio de menores, mientras que el 33,3% no lo ve así. Los jueces tienen roles clave: velar por el interés del niño (41,667%), evaluar su estado psicológico y físico (33,33%), y prevenir un matrimonio forzado (25%). La incapacidad de padres o abuelos es relevante en el 58,33% de las decisiones. Además, el 41,60% considera el embarazo de una menor al decidir sobre la dispensa judicial. El 50% desconoce el significado de emancipación jurídica y el 83,30% cree que la sociedad no está preparada para que los adolescentes asuman roles adultos. Los beneficios de la emancipación familiar se dividen en partes iguales entre "No importa" e "Importa" (50% cada uno). Se concluye que, existe una división de opiniones sobre el consentimiento parental y discrepancias entre la capacidad jurídica y la madurez de los adolescentes.
