It is here where he can find, say, the dynamic aspect of the mortgage, especially in the process of execution of guarantees. We have Article 1099, paragraph 3 of the Civil Code states that the validity of the mortgage, you must comply with one of its requirements, ie, to establish the amount of tax, which must be a fixed or determinable amount and enroll in registration of real property (property Registry today). Thus, there is no doubt that any mortgage granted to be valid must contain an amount with which it was encumbered the property in case of default of the secured obligation. No mortgage is valid if it does not contain the amount of the lien.La hipoteca es una figura que si bien cuenta con regulación en el Código Civil, en el cual encontramos los presupuestos para su validez y eficacia; entendemos sin embargo, que la misma desarrolla sus efectos con plenitud dentro del proceso civil. Es aquí en la que encontramos -se puede decir- el aspecto dinámico de la hipoteca, sobre todo en los procesos de ejecución de garantías. Tenemos que el artículo 1099 inciso 3 del Código Civil señala que para la validez de la hipoteca, se requiere cumplir con uno de sus requisitos, es decir, establecer el monto del gravamen, el cual debe ser una cantidad determinada o determinable y se inscriba en el registro de la propiedad inmueble (hoy Registro de Predios). Con lo cual, no cabe duda que toda hipoteca constituida, para su validez deberá contener un monto con el que se haya gravado el inmueble en caso de incumplimiento de la obligación garantizada.
