Proposing an ideal of cordial criminal justice as desirable is concluded. In this ideal, the judge resolves rationally as he is obliged to do, but his own emotions and those of the parties, which he can glimpse in an empathetic way, are his motivation.El artículo revisa el lugar que la teoría jurídica ha reconocido a las emociones y los sentimientos dentro de la justicia penal. Con base en una investigación documental, se esbozan dos modelos principales que se han desarrollado al respecto: el modelo dominante de racionalismo judicial, que plantea una dicotomía entre razón y emociones, y el modelo del emotivismo judicial, que reivindica la relevancia de las emociones en el derecho y la justicia. Se concluye proponiendo como deseable un ideal de justicia penal cordial.
