This based on the experience of the author, who was part of this process and the broad dialogue built around the precedent.El artículo tiene como propósito brindar una aproximación histórica sobre cómo y cuándo se introdujo el precedente en el derecho positivo peruano. Para ello se analizará el proyecto de ley discutido y elaborado por la Comisión de 1981, así como las reformas a las que fue sometido con motivo de los cambios constitucionales, hasta llegar al actual Código Procesal Constitucional.
