The German pandectist school regarding the concept of person, points out that the concept is vitiated from the root, with each moral and legal construction created. The historically determined person; instead concrete individuality, it is transferred to the plane of empiricism or relativity, then it is reduced to an abstraction, or turned into a fantastic subject. But natural law is historically the right of the person, as a concrete and defined individual, not an irrelevant atom, or a doll made to be exorcised.El presente artículo tratará sobre el concepto de persona en el derecho romano, desde su inicio con el nasciturus, concentrándonos en los status de la persona, tanto el social, civitatis, familiac, libertatis, así también un estudio de las personas jurídicas o morales existentes. Además analizaremos el concepto de persona en el derecho comparado y realizaremos una analogía con el derecho de personas en la legislación nacional. La escuela pandectista alemana respecto del concepto de persona, señala que el concepto se vicia desde la raíz, con cada construcción moral y jurídica creada. La persona históricamente determinada; envés individualidad concreta, viene transferida al plano del empirismo o de la relatividad, entonces es reducido a una abstracción, o convertida en un sujeto fantástico.
