Evidencia de la industria de extracción de cobre en Perú y ChileVillacorta Rath, RosaThis essay asks whether or not environmental legislation is one of the most important factors defining investment decisions in the copper mining industry, or if other factors are more important for decision-makers in those companies. Considering the relative importance of environmental legislation factors in the decision-making process, whether or not differences in environmental legislation between Peru and Chile have led to the migration of companies of one country to the other, phenomenon known as the Pollution Haven Hypothesis (PHH), is then analyzed. A survey was employed; both hypotheses were rejected. The fact that Peru has lower Maximum Allowed Limits (MAL) than Chile and that companies operating in the latter country have more voluntary certifications than the ones operating in Peru suggests the existence of PHH. Nevertheless, the claim that countries prefer to invest in Peru rather than in Chile because of the lower standards is not supported because almost the same Transnational Companies (TNCs) invest in both. In order to confirm the existence or not of a Pollution Haven (PH) in any of these countries, other factors such as the proportion of overall costs occupied by environmental regulation and the evolution of emissions should be assessed in further studies.El presente ensayo se pregunta si la legislación ambiental es uno de los factores que determina las decisiones de inversión en la industria minera de explotación de cobre, o si son otros factores más importantes para la toma de decisiones. Para ello, se analiza si las diferencias entre la legislación ambiental del Perú y Chile han ocasionado la migración de empresas del país más restrictivo al más permisivo, fenómeno conocido como la Pollution Haven Hypothesis (PHH o Hipótesis del Paraíso de Polución). El método de la encuesta fue empleado. Ambas hipótesis fueron rechazadas. El hecho de que el Perú cuente con límites máximos permitidos (LMP) menos estrictos que Chile y que las empresas en este país cuenten con una mayor cantidad de certificaciones voluntarias, sugiere la existencia de PHH. Sin embargo, no se pudo probar que las empresas prefieran invertir en el Perú en vez de Chile, dado que casi las mismas empresas transnacionales (ETN) invierten en ambos países.
