The JNE issued 26 resolutions without carrying out a proportionality test in accordance with the American Convention on Human Rights and the jurisprudence of the Inter-American Court of Human Rights. It is concluded that, in the 2016 elections, the JNE violated political rights by issuing four exclusion resolutions, while in the 2021 elections no candidates were excluded for this reason. However, none of the 26 cases should have been initiated, since the exclusion sanctions from the JNE do not conform to the guidelines established by the Inter-American Court in L´opez Mendoza vs. Venezuela and Petro Urrego vs. Colombia. It is recommended that Congress repeal article 42 or that the electoral justice disapply it throughcontrol of conventionality or constitutionality. This would ensure a more democratic electoral process, preservingthe right of candidates to be elected and of citizens to choose.En las elecciones generales peruanas de 2016 y 2021 los Jurados Electorales Especiales y el Jurado Nacional de Elecciones aplicaron el art´ıculo 42 de la Ley de Organizaciones Pol´ıticas, que permite la exclusi´on de candidatos que regalen u ofrezcan d´adivas a los votantes durante la campa˜na. El JNE emiti´o 26 resoluciones sin realizar un test de proporcionalidad conforme a la Convenci´on Americana sobre Derechos Humanos y la jurisprudencia de la Corte Interamericana de Derechos Humanos. Se concluye que, en las elecciones de 2016, el JNE vulner´o derechos pol´ıticos al emitir cuatro resoluciones de exclusi´on, mientras que en las elecciones de 2021 no se excluyeron candidatos por esta causa. No obstante, ninguno de los 26 casos debi´o haberse iniciado, ya que las sanciones de exclusi´on del JNE no se ajustan a las pautas establecidas por la Corte Interamericana en L´opez Mendoza vs. Venezuela y Petro Urrego vs. Colombia. Se recomienda al Congreso derogar el art´ıculo 42 o que la justicia electorallo inaplique mediante control de convencionalidad o constitucionalidad.
