A Iushumanist policy hopes that the doors of justice are always open so that form of state intervention produces the same effect with a lower social cost. As Master PieroCalamandrei said the Judge before applying Law, must first apply justice.Resulta obligatorio que los Fiscales justifiquen porqué piden las penas. Sería ideal que efectúen un desarrollo de argumentación similar al instrumento que aplican, indicando las razones que hacen permisivo su pedido. Nada los exonera de prescindir de un esfuerzo de justificación cuando pretendan privar de su libertad a un ser humano. Una política iushumanista espera que las puertas de la justicia siempre estén abiertas para que otra forma de intervención estatal produzca el mismo efecto con un menor costo social.
