The objective of the present research was to know if Huancavelicanos criminal judges render effective sentences to deprivation of liberty to doctors in cases of medical malpractice in 2016. The methodology is of the type of Descriptive Legal Research, also called diagnostic research, which is used when the objective is to detail how they are and how they manifest phenomena, situations, contexts and events. The results were that the criminal judges of the High Court of Justice in Huancavelica, do not declare sentences term of imprisonment in the crimes of medical malpractice, opting for suspended sentences. It was determined that 60% of the cases have indicated that the penalty of disqualification should apply to doctors who are sentenced with term of imprisonment in the medical malpractice.En el transcurso del tiempo el ejercicio de la medicina se fue desligando de su primitivo carácter sacerdotal y lentamente se ha transformado en un ejercicio realizado exclusivamente por los profesionales de la medicina. El objetivo de la presente investigación fue conocer si los jueces penales de Huancavelica dictan penas efectivas privativas de libertad a los médicos en los casos de negligencia médica en el año 2016. La metodología es del tipo de Investigación Jurídica Descriptiva, llamada también investigación diagnóstica, que se emplea cuando el objetivo es el de detallar cómo son y cómo se manifiestan fenómenos, situaciones, contextos y eventos. Los resultados fueron que los jueces penales de la Corte Superior de Justicia de Huancavelica no imponen penas privativas de libertad efectiva en los delitos de negligencia médica, optando por las penas suspendidas.
