Thus, our hypothesis states that various of the arbitral tribunals that have interpreted these treaties adopting a pragmatic approach have interpreted these clauses following various methods of interpretation, among which (i) the literal method, (ii) the teleological method, and (iii) the functional method of interpretation are predominant. In this sense, the main objective of the research will be to identify the main grounds used by the arbitral tribunals when analyzing the moment of invocation of these clauses in this type of treaties. To this end, the methodology used is qualitative in nature and seeks to be mainly analytical of existing jurisprudence. The aim is to directly analyze the decisions of existing arbitration cases and, indirectly, the bibliographical sources that analyze the decisions of this case law.Esta investigación busca absolver la pregunta de por qué los tribunales arbitrales han interpretado que los tratados concluidos por Estados Unidos recogen un enfoque pragmático con respecto a la invocación de las cláusulas de denegación de beneficios que contienen. De este modo, se plantea como hipótesis que diversos tribunales arbitrales que han interpretado estos tratados adoptando un enfoque pragmático, han interpretado estas cláusulas siguiendo diversos métodos de interpretación, entre los que priman: (i) el método literal; (ii) el método teleológico; y, (iii) el método funcional de interpretación. En ese sentido, el objetivo principal de la investigación consistirá en identificar los principales fundamentos empleados por los tribunales arbitrales al analizar el momento de la invocación de estas cláusulas en este tipo de tratados. Para ello, la metodología utilizada es una de carácter cualitativo y busca ser principalmente analítica de la jurisprudencia existente. Se buscarán analizar directamente las decisiones de casos arbitrales existentes e, indirectamente, las fuentes bibliográficas que analicen lo decidido por dicha jurisprudencia.Universidad de Lima.
