Sumario:This study examines the violation of due process in the direct procedure of Ecuador’s Organic Integral Penal Code (COIP), Article 640, in which judicial urgency compromises fundamental guarantees. Aiming to identify structural deficiencies that affect the right to defense and the impartiality of the judge, a mixed methodology with a descriptive approach was adopted, incorporating documentary analysis of norms and jurisprudence, and semi-structured surveys administered to justice system operators. The findings indicate a concentration of functions in the judge who determines flagrancy and directs the process, generating partiality; defense deadlines of three days create a procedural asymmetry; a conviction rate of 85%; and a majority perception (80%) of sacrificed guarantees. It is concluded that the current procedure breaches fundamental rights and a normative reform is proposed, validated by experts, establishing functional separation and extended deadlines to balance efficiency and justice.
