The objective is to analyze the constitutional framework of protection and application of the right to the life of unborn children in Ecuador, related to the decriminalization of abortion due to rape. The approach is qualitative, descriptive, with documentary design. A review of Ecuadorian jurisprudence and academic databases such as Dialnet, Redalyc and Scielo was carried out. The results reveal that the decriminalization of abortion for rape poses challenges, which strains the protection of the right to life since conception with reproductive rights and women's health. It is concluded that the legalization of abortion would imply a transgression of the right to life, and would undermine the essential principles of human dignity and the protection of the most defenselessEl nasciturus se desarrolla en una condición de vulnerabilidad, debido a que su desarrollo depende del proceso del útero materno y es de esta forma que nace el amparo de los derechos de la mujer frente a los que están por nacer. El objetivo es analizar el marco constitucional de protección y aplicación del derecho a la vida del nasciturus en Ecuador, relacionado con la despenalización del aborto por violación. El enfoque es cualitativo, tipo descriptivo, con diseño documental. Se realizó una revisión de la jurisprudencia ecuatoriana y bases de datos académicos como Dialnet, Redalyc y Scielo. Los resultados revelan que, la despenalización del aborto por violación plantea desafíos, ya que tensiona la protección del derecho a la vida desde la concepción con los derechos reproductivos y la salud de la mujer.
