The scale was administered to 256 inmates for the crime of violation of the sexual freedom of minors of a penitentiary institution of Metropolitan Lima, whose ages oscillated between 18 to 67 years. The results reveal a reliability, using Cronbach’s Alpha, for the total scale of 0.95. The factors of part a (aggressor thoughts) and b (feelings of aggressor) have reliability indexes of 0.96 and 0.92, respectively. All reliability coefficients are considered excellent. The exploratory factor analysis on both sides indicated that four factors underlie the items, while the goodness of fit to the model proposed by confirmatory factor analysis satisfactorily verify the empathy construct for the sample. It is concluded that the Empathy Scale has adequate psychometric properties, and it is recommended to carry out confirmatory factorial analysis in order to verify the internal structure.El objetivo del trabajo es conocer la aproximación de las propiedades psicométricas de la Escala de Empatía Situación C (partes a y b). La escala fue administrada a 256 internos por el delito de violación de la libertad sexual de menores de una institución penitenciaria de Lima Metropolitana, cuyas edades oscilaron entre 18 a 67 años. Los resultados revelan una confiabilidad mediante el Alfa de Cronbach, para la escala total de la situación C de 0,95. Los factores de las partes a (pensamientos agresor) y b (sentimientos de agresor) presentan índices de confiabilidad de 0,96 y 0,92, respectivamente. Todos los coeficientes de confiabilidad son considerados excelentes. Dentro del proceso de Validez de Constructo, el análisis factorial exploratorio de ambas partes indicó que son cuatro factores los que subyacen a los ítems, mientras que las bondades de ajuste al modelo propuesto por análisis factorial confirmatorio verifican satisfactoriamente al constructo de la empatía para la muestra.
