description Starting from the precept of the 1979 Constitution regarding the legal regulation of the forms of celebration of marriage, the author provides an analysis of the obstacles to implement the constitutional norm in the Civil Code under preparation. In this context, he presents a historical review of marriage, highlighting its evolution and its regulation as a religious, civil or mixed institution. In this regard, he points out that in Peru the tension between civil and religious marriage is discussed, and proposes to recognize canonical marriage to align the law with reality and respect freedom of conscience and belief. Among the obstacles, it includes the differences in the requirements for valid and licit marriages, the lack of state control in parish registries and the need to recognize the legal value of marriages of other beliefs. Along these lines, servinakuy, a form of customary law marriage union, is discussed and it is proposed that the State analyze this phenomenon. On the other hand, the author analyzes the norms of the Constitution that affect the civil regulation of the family, such as equality of the sexes in the law, responsible paternity, equality of matrimonial and extramarital children and family patrimony. It also deals with the regulation of common-law unions and concubinage, and other topics such as artificial insemination, contraception and abortion, and the legal and moral implications. With all this, the author proposes a revision of the Peruvian legislation to adapt it to the social and cultural reality, recognizing the diversity of marital forms and the implications of the constitutional norms in the legal regulation.

En ese marco, presenta un repaso histórico del matrimonio, destacando su evolución y su regulación como institución religiosa, civil o mixta. Al respecto, señala que en el Perú se discute la tensión entre el matrimonio civil y el religioso, y propone reconocer el matrimonio canónico para alinear la ley con la realidad y respetar la libertad de conciencia y de creencia. Entre los obstáculos, incluye las diferencias en los requisitos para el matrimonio válido y lícito, la falta de control estatal en los registros parroquiales y la necesidad de reconocer valor legal a matrimonios de otras creencias. En esa línea, se aborda el servinakuy, una forma de unión matrimonial de derecho consuetudinario, y se propone que el Estado analice este fenómeno. Por otro lado, el autor analiza las normas de la Constitución que inciden en la regulación civil de la familia, como la igualdad de los sexos en la ley, la paternidad responsable, la igualdad de hijos matrimoniales y extramatrimoniales y el patrimonio familiar. Asimismo, aborda la regulación de la unión de hecho y el concubinato, y otros temas como la inseminación artificial, anticoncepcional y aborto, y las implicaciones legales y morales.
