In this context, it discusses the division of rights into public and private, and how this is reflected in current legislation, despite theoretical difficulties in distinguishing them. The author analyzes the incorporation of individual rights into the constitutional order, with examples from Latin American constitutions such as those of Brazil, Mexico, Peru, Venezuela, and Cuba, which protect individual and social rights, although with variations in their effectiveness. The article also covers the American Declaration of the Rights and Duties of Man and the Inter-American Commission on Human Rights as regional mechanisms for the protection of human rights, recognizing that, in practice, factors such as poverty and totalitarian regimes limit the respect for these rights. Nevertheless, the author emphasizes the need for constitutionalists to work to ensure that the rights proclaimed in the constitutional texts become a reality in the political context of the region.El presente artículo aborda la posición de la persona en el derecho constitucional latinoamericano, su evolución histórica, y cómo ha sido abordada en la doctrina y los textos constitucionales. En tal contexto, se discute la división de los derechos en públicos y privados, y cómo esta se refleja en las legislaciones vigentes, a pesar de las dificultades teóricas para distinguirlos. Asimismo, el autor analiza la incorporación de los derechos de la persona en el orden constitucional, con ejemplos de constituciones latinoamericanas, como la de Brasil, México, Perú, Venezuela y Cuba, los cuales protegen derechos individuales y sociales, aunque con variaciones en su efectividad. También se aborda la Declaración Americana de los Derechos del Hombre y del Ciudadano y la Comisión Interamericana de Derechos Humanos como mecanismos regionales para la protección de los derechos humanos, aunque se reconoce que, en la práctica, factores como la pobreza y los regímenes totalitarios limitan el respeto de estos derechos.
