A position that strengthens the idea of the Constitutional State of law in its aspect of access to justice as a way to solve and legitimize justice in the daily work of citizens.El presente trabajo de investigación busca brindar buenas razones de reconocimiento e importancia en la participación ciudadana del proceso electoral de jueces de paz no letrados, fundamentándonos en la idea del soporte histórico constitucional de la justicia de paz, el concepto social de la justicia de paz desde el perfil de un juez socio-judicial y aspectos electorales de participación y garantía del proceso a través de la nulidad procesal. Se asume como principal conclusión que, existe una real necesidad de reconocer la justicia de paz como asunto vertebral en la sociedad y el apoyo al sistema judicial en sí a través de los buenos resultados de la justicia de paz y la propia expectativa de la población local en reconocer la justicia como elemento parte de sus derechos y deberes, por lo que la realización de elecciones democráticas de jueces de paz importa una visión institucional de la justicia descentralizada en todo el país. Una postura que fortalece la idea de Estado Constitucional de derecho en su aspecto de acceso a la justicia como forma de solucionar y legitimizar la justicia en el quehacer diario de la ciudadanía.
