The author remarks the fact that, although judges and bar associations are the main protagonists in the punishment of abuse of process, the recognition of this lawyer’s duty can contribute to clients’ rights protection and the consolidation of rule of law. From this perspective, the author proposes that every abuse of process circumstance is perpetrated because a lawyer incited it or because he or she consented it; for this reason, a (bad) lawyer will always be the one who caused the abuse. Precisely, one “remedy” for a lawyer involved in these practices consists in recognize the duty of all lawyers to denounce the (bad) colleagues, in defense of clients and rule of law.En el presente trabajo, el autor concluye que todo abogado debería encontrarse obligado a denunciar ante el Colegio de Abogados respectivo o ante el juez los casos de abuso del proceso que perjudiquen a su cliente, para que se sancione al abogado que se encuentra detrás de estas prácticas. El autor parte del hecho que, si bien el juez y los Colegios de Abogados son los principales llamados a sancionar el abuso del proceso, el reconocimiento de esta obligación del abogado puede ayudar a la protección de los derechos del cliente y a la consolidación del Estado Constitucional de Derecho. Bajo esa óptica, el autor plantea que todo supuesto de abuso del proceso es perpetrado ya sea porque un abogado lo incitó o porque lo consintió; por esta razón, siempre estará detrás un (mal) abogado.
