This paper analyzes the content of the right to be forgotten from a constitutional perspective, noting that there are translation problems when attempting to transplant this figure into the Chilean legal system. This is done by examining its elements through the lens of constitutional rights theory. In this sense, constitutional rights are principles, they may be subject to limitations and can compete with each other. This paper identifies some criteria to balance the right to be forgotten with the freedom of information on the internet and draws conclusions relevant to the implementation of the new data protection law in Chile.
