It also examines how access to justice manifests itself in practice and the real complications. In conclusion, the 1979 Constitution grants more protection by recognizing additional aspects of the Judiciary, reinforcing its structure and functionality. However, more modifications should be considered to achieve its purpose.El objetivo del presente trabajo es analizar el funcionamiento del Poder Judicial en el contexto de las modificaciones introducidas por la Constitución Política del Perú de 1979. Para ello, se examinan los artículos constitucionales relacionados con el Poder Judicial y su operatividad, destacando los cambios más significativos respecto a la Constitución de 1933. Además, se evaluará cómo se manifiesta en la práctica el acceso a la justicia y sus complicaciones reales. En conclusión, la Constitución de 1979 otorga un carácter constitucional más robusto al reconocer aspectos adicionales de la judicatura, fortaleciendo así su estructura y funcionalidad.
