Sumario:The matrimonial property regime is a crucial aspect of family law, since it regulates the management of property, rights and obligations between the spouses. Article 295 of the Peruvian Civil Code of 1984 establishes that future spouses may choose between two property regimes: community property and separate property. Under the first regime, property acquired during the marriage is considered social property, the purpose of which is to support the household economy and prioritise family interests. On the other hand, under the separation of property regime, each spouse retains individual ownership of his or her assets. In this work, the author carries out an exhaustive analysis of the matrimonial property regime, examining the key points of both regimes and providing relevant information for a more complete understanding of the subject.
