It is argued that in the field of international trade, the content, characteristics and role of non-binding measures are assessed to analyze their incompatibility with international standards and determine non-compliance of States.El objetivo de este artículo es analizar por qué las medidas no vinculantes adoptadas por los Estados pueden ser impugnadas para determinar el incumplimiento de las disposiciones de los acuerdos comerciales internacionales. En esta investigación se revisaron las decisiones de los órganos de solución de controversias de tres acuerdos comerciales: la Comunidad Andina, la Organización Mundial del Comercio y la Unión Europea.
