In the last ten years, different instances from the Indecopi and Supreme Court have issued contradictory rulings, evidencing a lack of consensus about the legality or illegality of said charges. Faced with this reality, the author wishes to show how the fixation on certain aspects of these cases have made jurists develop inattentional blindness, which lead them to base their reasoning on false premises. With this article, the author hopes to correct this mistake. In order to achieve this, he analyzes what is the duty of care, the difference between the concept of compensation and automatic debit, and, finally, the real disposable nature of remunerations. Thus, he highlights the aspects associated with charges made by financial institutions to customers’ accounts that are usually overlooked by the courts.En el Perú, no existe un criterio claro y uniforme para resolver las controversias sobre cobros efectuados por parte de empresas del sistema financiero a las cuentas de remuneraciones de sus usuarios como medio de compensación por deudas. En los últimos diez años, distintas instancias del Indecopi y de la Corte Suprema de Justicia han emitido fallos contradictorios, evidenciando una falta de consenso sobre la legalidad o no de estos cobros.Frente a este panorama, el autor plantea retratar cómo la fijación de los juristas en ciertos aspectos de estas controversias les ha generado una ceguera por inatención que los conduce a tomar como punto de partida premisas erróneas. El autor busca rectificar dicha equivocación. Para ello, analiza qué es el deber de idoneidad, la diferencia entre el concepto de compensación y de débito automático y, finalmente, el real carácter disponible de la remuneración.
