The decision criteria include DNA testing and possession of family status.The article recommends that the peruvian Judicial Power consider multiparenthood as an extension of the right to identity and parental responsibility, proposing its formalization in the civil registry to benefit the best interests of the child.Este artículo examina diez sentencias de casación de la Corte Suprema de Justicia del Perú, mostrando una preferencia por la biparentalidad en disputas de paternidad. Las decisiones privilegian la identidad estática del niño, basada en su derecho a conocer a sus padres biológicos según la ‘Convención sobre los Derechos del Niño’.A pesar del reconocimiento ocasional de la identidad dinámica, la multiparentalidad no ha sido considerada por los tribunales.
