It is concluded that the definition of death is a problem of great importance because of its legal consequences.El objetivo del presente trabajo es examinar los aspectos jurídicos relacionados con el trasplante de órganos. Para ello, se analizará el Código Sanitario, destacando los aspectos más problemáticos en la donación de órganos y proporcionando una interpretación más coherente para su aplicación. Además, se desarrollan los distintos tipos de muerte y su vínculo con la donación de órganos.
