What will be explored in this article is one of the cases that qualify to benefit from the fast-track process: the failing-firm defense exception.In summary, the Superintendence of Market Power Control has said that it will now take less time to review operations that target a company in economic difficulties, and it outlines the material parameters it will use to guide that decision. How-ever, such inclusion brings with it much more than it appears.El 20 de abril de 2020, la Superintendencia de Control del Poder de Mercado publicó la Resolución SCPM-DS-2020-018 con la que instaura un proceso abreviado o fast-track para investigar ciertas operaciones sujetas al régimen de notificación obligatoria ex ante. Lo que se explorará en este artículo es uno de los supuestos que califican para beneficiarse del proceso abreviado: la excepción de empresa en crisis o failing-firm defense. De manera resumida, la Superintendencia de Control del Poder de Mercado ha dicho que ahora se tardará menos tiempo en la revisión de operaciones que tengan como objetivo una compañía en dificultades económicas y traza los parámetros materiales que usará para guiar esa decisión.
