This closed system has lagged behind in relation to the open nature of numerus apertus, of unnamed measures, foreseen in Spanish, Colombian comparative law, among others, above all in the regulation of the concurrence of causes of the danger of legal harm by the delay of the final judgment (periculum in arrears) and the fumus bonis iuris or appearance of the good right. In this context, before the approval of a new Nicaraguan administrative litigation regulation, we have the opportunity to influence the development of this matter, offering lege ferenda proposals.El sistema de medidas cautelares, tanto en la justicia constitucional como administrativa nicaragüense, ha estado basado en la tradicional suspensión del acto administrativo, sin tomar en cuenta que, por ejemplo, en la inactividad administrativa no existe acto que suspender, pero, además, no se ha regulado como parte de la tutela judicial efectiva, aprobada en las recientes reformas constitucionales, propia del debido proceso y las garantías mínimas procesales. Este sistema cerrado ha quedado rezagado en relación con el de índole abierto de numerus apertus, de medidas innominadas, previsto en el derecho comparado español, colombiano, entre otros, sobre todo en la regulación de la concurrencia de causales del peligro de daño jurídico por el retraso del fallo definitivo, periculum in mora y el fumus bonis iuris o apariencia del buen derecho.
